Pretty lenient punishment for gross stupidity in my view. To be fair to the judge he seems to have felt his hands were tied by the powers he has.

Yes it's correct. There has been a lot of debate on this issue over the last few years but at the moment the status quo seems to be winning out, albeit difficult to police in the age of twitter.
