Identify This Bird Please

Can anybody identify the bird in these two photos please? It was in the Scandale Valley just north of Ambleside. It was surprisingly tolerant of me approaching to take a photograph.

Definitely a Kestrel the wide black band at the end of the tail is diagnostic, also the fact it looks ginger on the upper inner wing, Merlin is much more even brown on upper wing. This one has a very well marked face pattern and the scale is difficult to estimate where it is perched on the tree guard, so I can see why you think it might be Merlin.
